Welcome to Harmix Upload Terms
By sing Harmix A.I. services and uploading your content (e.g. audiovisual work, video) on Harmix website which is available at https://www.harmix.ai and https://web.harmix.ai or Harmix mobile application which could be downloaded from Google Play Market, Apple App Store, or Harmix ChatBot, or in-application extension (plugin) (hereinafter – ‘Harmix Platform’), you hereby agree to be bound by these Upload Terms.
You herewith warrant that:
- all of the rights to the content uploaded by you to the Harmix Platform belongs to you, or obtained by you from respective right owners;
- all content uploaded to Harmix Platform does not and will not infringe the rights of any third party;
- all content uploaded to Harmix Platform is deemed non-confidential and do not include sexual or pornographic material, defamatory, discriminatory or mean-spirited content or content that encourages violence.
You and/or your licensor retain ownership of any intellectual property rights (copyright or/and related rights) that you and/or your licensor hold in uploaded to Harmix Platform content. By uploading your content you give us non-exclusive, royalty free, irrevocable, transferable, worldwide license to use, adapt, modify, create derivative works, create digital copies of and otherwise use of your content for a provision of Harmix A.I. services.
All content uploaded by you to Harmix Platform is transmitted, stored and processed on a rented servers of the Amazon Web Services, Inc. (410 Terry Avenue North, Seattle WA 98109, United States) located in Frankfurt am Main, Germany. We do not guarantee that the Harmix Platform and Harmix A.I. will be always available or working uninterrupted and be free from errors or omissions.
After uploading your content, you have only 24 hours to set the parameters of the music for the Harmix A.I. After 48 hours since upload your content will be automatically deleted from the servers.
After obtaining the content created with the Harmix A.I., you have only 24 hours to download it. After 48 hours since obtaining the content created with the Harmix A.I. such content will be automatically deleted from the servers or stored confidentially only for the further improvement of the Harmix A.I. only if you gave your permission for such use by checking the respective box before uploading the video.
All the music used by the Harmix A.I. is subject to copyright and obtained under Creative Commons license from the YouTube Audio Library (content provider - Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) and could be used for commercial and non-commercial purposes. However, we can not guarantee that all the music will always be free for use or will not be subject to copyright infringement. You can contact the content provider for any legal matters regarding use of the music. You are legally liable for any infringement arising from the content created with the Harmix A.I. and its use.
You fully own the copyright to the derivative work (content) created with the Harmix A.I. You grant us non-exclusive, royalty free, irrevocable, sublicensable, transferable, worldwide license to use, adapt, modify, create derivative work, store, display, distribute, publicly perform, make digital copies of content created with the Harmix A.I. for:
- the improvement of the Harmix A.I. services, features, and functionality
- the marketing and promotional purposes, including but not limited to post such content on webpages, social media pages operated by us (e.g. we could post your content created with the Harmix A.I.) only if you gave your permission for such use by checking the respective box before uploading the video.
We reserve exclusive right to change and amend these Upload Terms without your any prior consent. These Upload Terms are exclusively governed by legislation of the United States of America.
